ORDER

This Criminal Original Petition has been filed by the petitioner to call for the records in Crime No.51 of 2022, dated 05.01.2022 on the file of the respondent police and quash the same in respect of the petitioner / Accused No. 3.

2. The learned Government Advocate appearing for the respondent would submit that they have already completed the investigation and filed final report and as per the final report, there are materials available to proceed further. Hence, the present petition is liable to be dismissed.

3. Since this petition is filed challenging the FIR and as per the FIR, there are some allegations to constitute the offences. Moreover, already the investigation was completed and charge sheet was filed. Therefore, it is appropriate to dispose this petition preserving the liberty of the petitioner to challenge the final report.

4. Accordingly, this Criminal Original Petition stands disposed of preserving the liberty of the petitioner to challenge the final report in the manner known to law. Consequently, connected Miscellaneous Petition stands closed.
