ORDER : The Court Made the following order :- The petitioners, who are arrayed as accused, apprehending arrest at the hands of the respondent police, for the alleged commission of offences punishable under Sections 406, 420 and 506(ii) I.P.C., in Crime No.not known of 2015, on the file of the respondent police, seek anticipatory bail.
2. The case of the prosecution is that the petitioner in Crl.O.P.(MD) No.21601 of 2015 married the de-facto complainant by suppressing the earlier marriage and cheated the de-facto complainant. The petitioner in Crl.O.P.(MD) No.21599 of 2015 is the wife of the petitioner in Crl.O.P. (MD) No.21601 of 2015.
3. The learned counsel for the petitioners submitted that the petitioners are the family friends of the de-facto complainant and the petitioner in Crl.O.P.(MD) No.21601 of 2015 helped the de-facto complainant in her daughter's function. In order to grab money from the petitioners, she has given a false complaint against them. He further submitted that the petitioners are innocent persons and they have not committed any offence as alleged by the prosecution. https://hcservices.ecourts.gov.in/hcservices/

The learned counsel for the de-facto complainant submitted that both the de-facto complainant and the petitioner in Crl.O.P.(MD) No.21601/2015 are married in the year 2005 and they are living separately for the past 10 years, subsequently, suppressing the earlier marriage, he married the petitioner in Crl.O.P.(MD) No.21599/2015.
5. The learned Government Advocate (Crl. side) submitted that based on the complaint of the de-facto complainant, a case has been registered against the petitioners, in Crime No.23/2015, for the offences punishable under Sections 417, 294(b) and 506(ii) IPC.
6. Considering the facts and circumstances of the case and also considering the age of the petitioners, this Court is inclined to grant anticipatory bail to the petitioners with certain conditions. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate, Nilakottai, and on each of them executing a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner in Crl.O.P.(MD) No.21601 of 2015 shall report before the respondent police on every Sunday at 10.30 a.m., for four weeks and thereafter, as and when required for interrogation. The petitioner in Crl.O.P.(MD) No.21599 of 2015 shall report before the respondent police, as and when required for interrogation. The petitioners shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously.
7. The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which the petitions for anticipatory bail stand dismissed. sd/- 19/11/2015 / TRUE COPY / Sub-Assistant Registrar (C.S.)
