JUDGMENT
When the matter is taken up for hearing, the learned counsel appearing for the appellant submits that the issue between the appellant and the respondent was settled amicably and seeks permission of this Court to withdraw the second appeal on the ground of settlement out of the Court. The learned counsel also prays for refund of Court fee and he has made an endorsement to that effect.
2. Accordingly, permission is granted and the Second appeal is dismissed as withdrawn. Registry may refund the Court fee to the appellant as per Rules. No costs. Consequently, connected miscellaneous petition is closed. 03.10.2023 NCC : Yes / No Index : Yes / No Internet : Yes / No cp 2/4
