Respondent PRAYER : Second Appeal is filed under Section 100 of the Code of Civil Procedure, to set aside the judgment and decree of the First Additional District Judge, Madurai, in A.S.No.89 of 2018, dated 08.03.2022, confirming the decree and judgment of the Sub Court, Thirumangalam in O.S.No.942 of 2017 (Old No. 1032 of 2010) dated 12.03.2018 and dismiss the suit by allowing this second appeal with costs.

JUDGMENT

When the matter is taken up for hearing, the learned counsel appearing for the appellant submits that the issue between the appellant and the respondent was settled amicably and seeks permission of this Court to withdraw the second appeal on the ground of settlement out of the Court. The learned counsel also prays for refund of Court fee and he has made an endorsement to that effect.

2. Accordingly, permission is granted and the Second appeal is dismissed as withdrawn. Registry may refund the Court fee to the appellant as per Rules. No costs. Consequently, connected miscellaneous petition is closed. 03.10.2023 NCC : Yes / No Index : Yes / No Internet : Yes / No cp 2/4
