Prayer : To grant an interim leave to the detenue namely, Fayajdeen, S/o.Farook Ali, aged about 47 years, who is now detained as Goonda at Central Prison, Trichy, vide detention order passed in D.No.110 of 2025 dated 08.12.2025 on the file of the 2nd respondent for a period of 6 days without escort pending disposal of the above H.C.P(MD)No.62 of 2026 on the file of this Court.

O R D E R
[Order of the Court was made by G.K.ILANTHIRAIYAN, J.] This Criminal Miscellaneous Petition has been filed seeking an interim leave to the detenu for a period of 6 days without escort.
2. The petitioner filed the main H.C.P(MD)No.62 of 2026 challenging the order of detention dated 08.12.2025. While pending the
main H.C.P(MD)No.62 of 2026, this Criminal Miscellaneous Petition has been filed seeking interim relief on the ground that the detenu's father was admitted in Vadamalayan Hospital, Dindigul for suffering of low oxygen and respiratory distress and suffering with cancer at last stage.
3. On instructions, the learned Additional Public Prosecutor submitted that the representation submitted by the petitioner is under consideration and it will be disposed of.
4. Further the petitioner who is the brother of the detenu submitted a representation only before the 2nd and 3rd respondents herein. The provision under Section 15 of the Act 14, provides temporary release of a persons detained under Act 14, the Government has got power to grant interim relief. Therefore, the 3rd respondent is directed to forward the representation submitted by the petitioner dated 28.01.2026 before the 1st respondent and on receipt of the same, the first respondent is directed to dispose of the same forthwith.
5. With the above direction, this Criminal Miscellaneous Petition is disposed of.
