Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners, who are arrayed as accused Nos.4 to 6, apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 21(4) of Mines and Minerals (Development and Regulation) Act and 379 of I.P.C., in Crime No.17 of 2011 on the file of the respondent police and hence, seek anticipatory bail.

2. The case of the prosecution is that on 07.02.2011, the accused had transported sand through bullock cart without any valid permit.

3. The learned counsel for the petitioners submitted that the petitioners are innocent and they have been falsely implicated in this case. It is further submitted that the co-accused viz., A1, A2, A3 and A7 were already arrested and released on bail.

4. Heard the learned Government Advocate (Crl.side).

5. Considering the facts and circumstances of the case and also considering the fact that the co-accused were already released on bail, this Court is inclined to grant anticipatory bail to the petitioners with certain conditions. Accordingly, the petitioners are ordered to be released on bail in the event of their arrest or on their appearance before the learned Judicial Magistrate, Cheranmahadevi and on their executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and the petitioners shall appear before the https://hcservices.ecourts.gov.in/hcservices/

respondent police daily at 10.00 a.m. until further orders. The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

6.
