ORDER : The Court made the following order :- The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under sections 406 and 420 of IPC, in Crime No.Not Known of 2020, on the file of the respondent police, seeks anticipatory bail.

2.According to the prosecution, the petitioner herein has collected huge amount from 12 persons promising job in foreign country. Besides collected money, he also collected their passport. During the petition enquiry, the accused persons had only returned the money, that too to two victims only and for rest they are yet to be repaid.

CRL OP(MD). No.2627 of 2020 3.The learned counsel appearing for the petitioner would submit that after receiving the petition, the respondent police went to the house of the petitioner at chennai broke open his house and taken away his property documents and jewels. In this regard, the petitioner has given a complaint to the human rights commission. 4.This Court while considering the progress of the investigation, it reveals that the passport of victims yet to be recovered. The petitioner complaint to human rights commission cannot be use as a shield for his act of cheating. Hence, this court finds no reason to grant anticipatory bail. The respondent shall proceed with the petition enquiry. The petitioner shall cooperate with the police in respect of the complaint against him instead of staying away. The respondent on the basis of the material collected during investigation shall proceed as per law. 5.With the above observation, this criminal original petition is disposed of.
