For Respondent : Mr.V.Neelakandan Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.200 of 2019 on the file of the respondent police.

ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 147,148,294)b),323,324,307,,(ii) and 427 of IPC seeks anticipatory bail.

2. Heard both sides.

3.The learned counsel appearing for the petitioner has submitted that the petitioner is innocent and he has been falsely implicated in the above case. He further submitted that already coaccused in this case was granted bail by this Court in Crl.O.P(MD) No.7856 of 2019. Hence, he prayed for grant of anticipatory bail to the petitioner.

4.The learned Additional Public Prosecutor would submit that due to some wordy quarrel the petitioner along with others attacked the victims with deadly weapons. He would further submit that two https://hcservices.ecourts.gov.in/hcservices/

previous cases are pending against the petitioner under Sections 307 of IPC and 188 of IPC. He would also submit that investigation is still pending and custodial interrogation is absolutely necessary. Hence he opposed to grant anticipatory bail to the petitioner.

5. Since two previous cases are pending against the petitioner the petitioner cannot claim parity with A5. Taking into consideration of the aforesaid facts and also the submission of the learned Additional Public Prosecutor, the custodial interrogation is absolutely necessary, this Court is not inclined to grant anticipatory bail to the petitioner.
