ORDER

Seeking to transfer the investigation of the case in Crime No.23 of 2026 on the file of the 2nd respondent to any other investigating agency, this criminal original petition is filed.

2. The learned counsel for the petitioner submitted that on his instance. F.I.R in Crime No.23 of 2026 came to be registered by the 3rd respondent for the offences under SC/ST (Prevention of Atrocities) Act, 1989. The petitioner is a differently abled person belonging to the Scheduled Caste community. In the prevailing pathway dispute between the petitioner and one Vasu, continuously troubles are being created by the family members of the said Vasu by abusing him in filthy language mentioning his disability as well as his caste. In this regard, the petitioner had lodged complaint to the 3rd respondent police on 23.01.2025, 12.09.2025 and representations were also made on 16.10.2025 and 22.10.2025. However, the 3rd respondent police failed to take action in this regard. Hence, the petitioner filed Crl.O.P(MD)No. 2/6

22965 of 2025 before this Court and the same was allowed directing the respondent police to take appropriate action. Despite the same, investigation has not concluded and final report has not been filed and hence, this petition.

3. The learned Government Advocate(Crl.Side) submitted that as per the directions of this Court, F.I.R has been registered on 15.01.2026.

4. Heard the learned counsels on either side and carefully perused the materials available on record.

5. Considering the fact that the petitioner being differently abled person belonging to Scheduled Caste community, the 3rd respondent should have sensibly dealt with the case. However, it is seen that only after the direction passed by this Court in Crl.O.P(MD)No.22965 of 2025, the police had even managed to file a First Information Report. In this regard, the 3rd respondent police is reprimanded for their inaction 3/6

and the 2nd respondent police is directed to take steps to conclude the investigation as expeditiously as possible within a period of four(4) weeks from the date of receipt of copy of this order and further directed to appraise the progress of the investigation every Friday to the 1st responder and the 1st respondent is directed to monitor the ongoing investigation and make sure that the investigation is concluded within a period of four (4) weeks.

6. With the above directions, this Criminal Original Petition stands disposed of.
