PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, directing the respondents 1 to 3 herein to remove the illegal common pathway encroachment made by the fourth respondent in the public common pathway situated in Town Survey No.11 Vazhavantha Amman Kovil Street, Manimurtheeswaram, Tirunelveli on the basis of petitioner's last representation dated 04.08.2025 within a stipulated time as that may be fixed by this Court. ORDER

(Order of the Court was made by N.SATHISH KUMAR, J.) The petitioner has filed the present writ petition seeking a direction to respondents 1 to 3 to remove the alleged encroachment made by the fourth respondent on the common public pathway situated in Town Survey No. 11, Vazhavantha Amman Kovil Street, Manimurtheeswaram, Tirunelveli.

2. The second respondent has filed a status report. A perusal of the report reveals that, upon inspection of the said site, no permanent structure or encroachment was found to exist on the public pathway. Only thorny shrubs and a few damaged cement roofing sheets were found at the site.

3. The learned Additional Government Pleader appearing for the first respondent submitted that the aforesaid materials were duly cleared and removed subsequent to the inspection.

4. In view of the above submission, nothing survives for adjudication in the writ petition. Accordingly, the writ petition stands dismissed. There shall be no order as to costs. [N.S.K.,J.] [M.J.R.,J.] 24.03.2026 NCC : Yes / No Index : Yes / No Internet : Yes 3/5
