: Respondents/Respondent PRAYER : Petition is filed under Section 482 of Criminal Procedure Code praying to direct the fourth respondent forward the petitioner's complaint dated 19.05.2019 to the file of the second respondent for the purpose of conducting an enquiry and to take further action pursuant thereto in accordance with Cr.P.C.. ORDER
This petition has been filed to direct the fourth respondent to forward the complaint of the petitioner to the second respondent for the purpose of conducting enquiry.
2. The grievance of the petitioner is that he has given a complaint before the third respondent against one Rangaraja Narasimman, who is said to have abused the petitioner. He would further submit that under Section 7 of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act (in short 'Act'), the Deputy Superintendent of Police is alone competent to investigate the complaint lodged under the Act. But, the second respondent, without transferring the complaint of the petitioner to the fourth respondent, is keeping the matter pending. Hence, the https://hcservices.ecourts.gov.in/hcservices/
present petition has been filed.
3. The learned Government Advocate (Crl.Side) appearing for the respondents, on instructions, would submit that based on the complaint given by the petitioner a FIR in Crime No.144 of 2019 has been registered and now the crime has been referred to the Deputy Superintendent of Police, G.A.Puram Police Station after obtaining necessary proceedings from the Superintendent of Police.
4. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) for the respondents.
5. Considering the facts and circumstances of the case and also considering the fact that based on the complaint given by the petitioner, FIR has been registered and the investigation of the same has been handed over to the Deputy Superintendent of Police as per the provisions of the Scheduled Casts and Scheduled Tribes (Prevention of Atrocities) Act, no further adjudication needs to be entertained in this petition. Accordingly, this Criminal Original Petition is closed.
