PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying to direct the first respondent to register a case based on the Petitioners complaint dated 02.09.2018 as per the order passed by the learned Judicial Magistrate Court Papanasam in Crl.M.P.No.1090/2020 dated 18.03.2020.

ORDER

This petition has been filed seeking direction to direct the first respondent to register a case based on the petitioner's complaint dated 02.09.2018 as per the order passed by the learned Judicial Magistrate Court Papanasam in Crl.M.P.No.1090/2020 dated 18.03.2020.

2.The petitioner has lodged complaint before the first respondent and he was issued CSR No.583 of 2018, however it was not registered, hence the petitioner was constrained to approach the learned Judicial Magistrate, Papansam under Section 156(3) of https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P.(MD) No.3152 of 2022 Cr.P.C in Crl.M.P.No.1090 of 2020, wherein the learned Magistrate has directed the first respondent to investigate the case and to file a report on or before 08.05.2020. Even after 18 months the first respondent did not register the First Information Report as directed by the learned Magistrate.

3. The learned Additional Public Prosecutor would submit that as per the direction of the learned Magistrate, First Information Report came to be registered in Crime No.111 of 2022 for the offences under Sections 294(b).323,354,379,427 of IPC and Section 4 of TNPHW Act.

4. Recording the same, the petition stands closed. However the first respondent is directed to complete the investigation and file the final report before the concerned Court within a period of 12 weeks from the date of receipt of a copy of this order.
