ORDER
This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the respondents to rectify the patta by restricting the extent to 87 cents instead of 95 cents in Survey Nos.21/2B, 21/2A and 21/3A1, forming part of a total extent of 109 cents, situated at Managiri Village, 1st Bit, Madurai North Taluk, Madurai District, in accordance with the sale deed dated 17.09.2020, by considering the petitioner's representation dated 01.09.2025.
2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.
3. The learned counsel appearing for the petitioner would submit that the
petitioner is the lawful owner and in possession of the subject property situated at Managiri Village, 1st Bit, Madurai North Taluk, Madurai District, covered under Survey Nos.21/2B, 21/2A and 21/3A1. As per the sale deed dated 17.09.2020, the petitioner is entitled to an extent of 87 cents; however, due to an error, the patta has been issued for 95 cents, which is incorrect. To rectify the said mistake, the petitioner submitted a representation dated 01.09.2025 to the respondents requesting correction of the patta entries. Despite the lapse of considerable time, the respondents have failed to consider and dispose of the representation, causing prejudice to the petitioner. Hence, the petitioner has been constrained to approach this Court by filing the present Writ Petition.
4. The learned Additional Government Pleader appearing for the respondents submits that the petitioner's representation dated 01.09.2025 will be considered and appropriate orders will be passed on merits and in accordance with law.
5. Recording the aforesaid submission, and without expressing any opinion
on the merits of the matter, this writ petition is disposed of with a direction to the second respondent to consider the petitioner's representation dated 01.09.2025, and pass appropriate orders on merits and in accordance with law within a period of sixteen weeks from the date of receipt of a copy of this order. The representation shall be considered and disposed of after conducting an enquiry. The second respondent is directed to provide reasonable opportunity during such enquiry to the petitioner, and any other persons, who may be affected by such decision. Needless to state that in the event of any rival claims, the parties are at liberty to work out their remedies before the Civil Court. There shall be no order as to costs.
