PRAYER: Criminal Original Petition is filed under Section 482 of Cr.P.C., to direct the second respondent herein to transfer the investigation of the case in Crime No.397 of 2018 from the second respondent to the third respondent.

ORDER

This petition has been filed to direct the second respondent herein to transfer the investigation of the case in Crime No.397 of 2018 from the file of the second respondent to the file of the third respondent.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing for the official respondents and perused the materials placed on record.

3. The grievance of the petitioner is that based on the complaint given by the petitioner a case has been registered in Crime No.397 of 2018 for the offences under Sections 464, 468 and 471 IPC. Even though a case has been registered in July 2018, sofar no investigation is conducted. Hence, the petitioner has filed the present petition seeking to transfer the investigation of the said case.

4. The learned Government Advocate (Crl.Side) appearing for the respondents, on instructions, would submit that substantial part of investigation is over and within a period of two months the respondent police will file final report in this case.

5. Recording the submission made by the learned Government Advocate (Crl.Side) and also considering the fact that the substantial part of investigation is over and final report will be filed shortly, the prayer sought for by the petitioner in this case need not be considered at this stage. However, the respondent police is directed to complete the investigation in Crime No.397 of 2018 and file a final report within a period of one month from the date of receipt of a copy of this order.

6. With the above direction, this Criminal Original Petition is disposed of.
