.. Contemnors/Respondents Contempt Petition is filed under Section 11 of Contempt of Courts Act, 1971, to punish the respondents/contemnors for willfully disobeying the order passed by this Court in W.P.(MD).No.20309 of 2016 dated 21.10.2016.

Prayer in WP(MD). 20309/ 2016 :

Writ Petition is filed under Article 226 of the Constitution of India, praying this Court To issue a Writ of Mandamus directing the Respondents to revise the petitioners pay for the period from 01.09.2013 to 28.02.2014 based on the terms of settlement dated 13.04.2015 entered under Section 12(3) of Industrial Disputes Act, 1947 by giving pay revision at the rate of 5.5% and to pay his surrender leave salary for the period of 60 days commencing from 2011 to 2014 and further directing the Respondents to pay him the difference amount in his salary for the period from 01.09.2013 to 28.02.2014 to till date together with interest at the rate of 18% per annum based on the said Settlement. ORDER

When this matter is taken up for hearing, it is represented by the learned Standing Counsel that the monetary benefits have been disbursed to the petitioner herein and he further submitted that the respondents are agreed to pay the balance amounts with regard to the surrender leave salary by way of six equal instalments. He also produced a copy of the letter dated 05.02.2021. Recording the same, this contempt petition is closed. However, if any dues payable to the petitioner, he is at liberty to work out his remedy in the manner known to law.
