Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who is arrayed as Accused No.4, prays for the grant of anticipatory bail under Section 438 of Cr.P.C. for alleged offences punishable under Sections 147, 427 and 506(i) IPC in Crime No.409 of 2015 on the file of the respondent police.
2. The case of the prosecution is that on 10.11.2015 at about 10.00 p.m. all the accused persons have entered into the de-facto complainant's land and damaged a shed and when the same was questioned, the petitioner and other accused have threatened the de-facto complainant with dire consequences.
3. The counsel for the petitioner submits that the petitioner is a practising Advocate at Trichy and he is not guilty of any wrong doings as alleged.
4. The Government Advocate (Crl. Side) submits that no one sustained injury in this case.
5. Considering the facts and circumstances of the case and that the submissions made, this Court is of the view that the petitioner can be granted the relief prayed for and accordingly; (a) In the event of arrest by or on appearance before the respondent police;
(b) *In the event of appearance before the learned *Judicial Magistrate Lalgudi within 15 days from the date of receipt of copy of the order, https://hcservices.ecourts.gov.in/hcservices/
(i) the petitioner shall be enlarged on bail on executing his own bond for Rs.10,000/- (Rupees ten thousand only) to their satisfaction; (ii) *the petitioner shall appear before the respondent police daily at 05.45 p.m. for a period of two weeks and thereafter, as and when required for interrogation.
