ORDER
This Criminal Original Petition has been filed to direct the first and second respondents to reinvestigate the case in C.C.No.129 of 2012 in Crime No.392 of 2011 on the file of the Special Judicial Magistrate, Theni, with the competent Officer.
2. The first petitioner herein is the defacto complainant/mother and the second petitioner is her daughter, who is an Advocate and witness to the occurrence.
3. As against the contention of the petitioners that though 161(3) Cr.P.C statements stood properly recorded at the first instance, further 161(3) Cr.P.C statements were recorded towards aiding some of the accused, status report of the respondents informs that such is not the case and upon the petitioners admitting to an exaggeration in their https://hcservices.ecourts.gov.in/hcservices/
earlier version, final report informing commission of offence by the sole accused has been filed. The case has been taken on file in C.C.No.5 of 2014 by the learned Special Magistrate, Theni and stands posted to 11.03.2015 for examination of P.Ws.1 and 2 and witness warrant has been issued. It is also seen that a counter complaint preferred by the accused has been closed as 'mistake of fact'.
4. In such circumstances, we see no reason to suspect any wrong doing on the part of the respondents. Hence, this Criminal Original Petition shall stand dismissed.
