O R D E R

This Writ Petition has been filed seeking the issuance of a Writ of Certiorarified Mandamus to quash the impugned order passed by the respondent against the petitioner vide:2025/0105/23/317869, dated 17.10.2025 and consequently to direct the respondent to issue patta to the petitioner based on the patta application of the petitioner in 2025/0105/2023/317869.

2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.

3. The learned counsel for the petitioner submits that the petitioner made a request for a change in patta. However, his request was rejected and the online application status shows as "Rejected". Hence, the present petition is filed to set aside the impugned order. 2/5

4. The learned Government Advocate appearing for the respondent submits that the application was rejected on the ground that a civil suit is pending.

5. On a perusal of the impugned order, it is evident that neither the details of the civil suit nor the specific impediment for refusing to transfer the patta have been stated therein. This omission, by itself, is sufficient to warrant setting aside the order, so as to enable the authority to furnish appropriate and cogent reasons in the event the request is rejected.

6. For the above reason, the impugned order deserves to be set aside. Accordingly, it is set aside.

7. With the above observations, this Writ Petition is disposed of. No costs. Consequently, the connected Miscellaneous Petition is closed.
