PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the 1st respondent to process the application of the petitioner for the re-issuance of passport vide application No. MD. 1075818803725 and re-issue the passport to the petitioner within a time fixed by this Court.

ORDER

The present writ petition has been filed seeking a mandamus directing the first respondent for reissuance of the passport to the petitioner based upon his application No.MD.1075818803725.

The learned Government Advocate(crl.side) appearing for the respondents 2 and 3 submitted that the petitioner was implicated in a criminal case in Cr.No.155 of 2017 on the file of the second respondent and the same has been referred as mistake of fact. The petitioner has also been implicated in another criminal case in Cr.No.71 of 2022 on the file of the third respondent which has culminated in filing of a charge sheet in C.C.No.87 of 2023 on the file of the Additional Mahila Court, Theni, and the same is pending trial.

3. In view of the above said facts, the petitioner is directed to approach the concerned trial Court seeking permission of the Court to go abroad. In case any such application is filed, the same shall be disposed of within a period of 2/4

4(four) weeks. Based upon the orders to be passed by the concerned trial Court, the first respondent is directed to proceed in accordance with law.

4. With the above said observations, this writ petition stands disposed of. No costs.
