Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct respondents 1 to 9 to remove and close the opening in the NH-38 Madurai to Tuticorin Road in front of the Hotels of Respondents 10 and 11 and take action against the 10th respondent for his illegal encroachment in the National Highways and for letting drainage into the water body of the 9th respondent Panchayat. [Order of the Court was made by S.M.SUBRAMANIAM, J.] The writ on hand has been instituted to direct respondents 1 to 9 to remove and close the opening in NH-38 Madurai to Tuticorin Road in front of the Hotels of respondents 10 and 11 and take action against the tenth respondent for his illegal encroachment of the National Highways and for letting drainage into the water body of the ninth respondent Panchayat.

2. The learned Special Government Pleader, based on the written instructions given by the Revenue Tahsildar, Ettaiyapuram would submit that encroachments are identified and necessary reports are submitted to the authorities of the National Highways Authority of India.

3. Since encroachments are identified, the official respondents are directed to initiate all appropriate actions to remove the encroachments as contemplated under law.

4. With the above direction, this Writ Petition stands disposed of. There shall be no order as to costs.
