Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorari, to call for the records pertaining to the impugned press news 09.02.2021 issued by the second respondent quash the same as illegal.

Heard the learned counsel for the petitioner and the learned Government Advocate for the respondents.

2.The petitioner was appointed to the post of Field Worker on 30.08.2012 under the Integrated Child Protection Scheme (ICPS). The terms of his appointment was on contractual basis for a period of one year. Thereafter, the service of the petitioner herein was extended for every year for the subsequent periods on contractual basis.

3.The petitioner herein is now aggrieved against the press news, dated 09.02.2021, which calls for applications for appointment to the post of Field Workers.

4.The learned counsel for the petitioner would submit that since the petitioner's service has been continuously extended from the year 2012 onwards on annual basis, his candidature should be given preference and that since he has no bad remarks, which is evidenced by the conduct of the respondents in extending his period every year, there was no necessity for the respondents to call for https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD) No.3341 of 2021 application to fill up the post of Field Worker. 5.I am not in agreement with the said submission. The petitioner has been appointed purely on contract basis for a period of one year only with effect from 30.08.2012. Just because the respondents had chosen to extend his period subsequently every year, would not confer the petitioner any right to either have a preferential consideration in the present impugned notification or would give raise to a cause of action to quash the notification calling for application for the post of Field workers. However, if the petitioner is qualified to apply for the same post, it would always open to him to participate in the selection process by making an appropriate application.

6.In this background, I do not find any merit in the present writ petition that could warrant interference. Accordingly, this Writ Petition stands dismissed. No costs. Consequently, connected miscellaneous petitions are closed.
