ORDER

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the first respondent to take the complaint dated 17.1.2020 into file preferred by the Petitioner regarding the affairs of FMD-10 Fisherman Cooperative Society, Bodinanayakanur and take necessary action after conducting an enquiry.

2.Mr.M.Rajarajan, learned Government Advocate takes notice for the respondents.

3. By consent of parties, the main Writ Petition is taken up for final disposal.

4.The case of the petitioner is that the petitioner is a member of the FMD-10, Bodi Fisherman Cooperative Society, Bodinayakanur for the past 25 years. For more than two decades, election to the society was not held and when election was announced in the year 2019, with several irregularities, the election was conducted and the third respondent herein was declared as the winner. W.P(MD)No.3006 of 2020 raised a dispute before the second respondent on 23.12.2019 and the said enquiry is pending at the stage of issuing notice to the third respondent. While so the third respondent has conducted a meeting of the above society in a remote village namely, Kodankipatti, which is 15 kms away from Bodinayakanur, when the society itself has a Head Office at Bodi. Questioning the above said act, the Petitioner has sent a complaint, dated 17.1.2020 to the first respondent The same is said to be still pending, without any progress. Hence, the petitioner has come forward with the present Writ Petition for the above stated relief.

Therefore, without expressing any opinion on the merits of the claim made by the petitioner, the first respondent is directed to consider the representation/complaint of the petitioner, dated 17.01.2020 and pass appropriate orders on the same, on merits and in accordance with law, after giving due opportunity of hearing to all the parties concerned, within a period of four weeks from the date of receipt of a copy of this order.

With the above direction, the Writ Petition is disposed of. No Costs.
