PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying to direct the second respondent to issue Non-Traceable Certificate to the petitioner with regard to the missing original sale deed Document No.1563/1960 dated 15.09.1960 on the file of the Joint I Sub-Registrar, Tirunelveli which is relating to the land in S.No.49/4 admeasuring 6 cents situated at Manimoortheeswaram Village, Tirunelveli Taluk within a time stipulated by this Hon'ble Court.

ORDER

This petition has been filed seeking direction to direct the second respondent to issue Non-Traceable Certificate to the petitioner with regard to the missing original sale deed Document No.1563/1960 dated 15.09.1960 on the file of the Joint I SubRegistrar, Tirunelveli which is relating to the land in S.No.49/4 admeasuring 6 cents situated at Manimoortheeswaram Village, Tirunelveli Taluk.

2. The petitioner's father has executed a Will dated 01.09.1968, registered vide document No.33/1968 in favour of the petitioner. His father originally purchased the said property by registered sale deed vide document No.1563/1960, however the original sale deed was lost, as such the petitioner has filed a complaint before the second respondent police on 16.07.2021 and the petitioner was issued CSR No.333 of 2021. The petitioner has also produced all relevant documents to the second respondent for issuance of non traceable certificate. The second respondent has closed the enquiry on 10.09.2021.

3. Considering the above the petitioner is directed to lodge a fresh complaint before the second respondent and on receipt of the same, the second respondent is directed to conduct enquiry and issue non traceable certificate to the petitioner within a period of two weeks therefrom.

4. With the above direction, the Criminal Original Petition is disposed of.
