ORDER

This Civil Miscellaneous Petition has been filed to permit the petitioner to withdraw 50% of the tribunal award amount with proportionate accrued interest and costs which was deposited by the first respondent in M.C.O.P.No.107 of 2015 on the file of the Motor Accident Claims Tribunal/Special District Court, Tiruchirappalli. 2/4

2. Heard the learned counsel for the petitioner.

3. The learned counsel for the first respondent submits that the petitioner may be permitted to withdraw 50% of the deposited amount.

4. I have perused the affidavit filed in support of this application and being satisfied with the reasons stated in the affidavit and also considering the submissions made by both side learned counsel, this Court is inclined to allow this petition.

5. Accordingly, this Civil Miscellaneous Petition is partly allowed. The petitioner is permitted to withdraw 50% of the deposited amount with proportionate accrued interest and costs by filing necessary application before the Motor Accident Claims Tribunal/Special District Court, Tiruchirappalli.
