PRAYER: Criminal Original Petition is filed under Section 482 of Cr.P.C., to direct the third respondent thereby not to harass the petitioner in the case of bias enquiry with the retribution motivation of the fourth and fifth respondents as well as pleased to give a direction to the first respondent to initiate a department enquiry as against the third respondent herein for his willful act as conducted Katta Panchayat at Kollidam Police Station, Trichy District.

ORDER

This petition has been filed to direct the third respondent police not to harass the petitioner.

2. The grievance of the petitioner is that there is a money dispute between the petitioner and the fourth respondent. Pursuant to the same, based on the complaint given by the fourth respondent, the respondent Police is harassing the petitioner. Hence, the petitioner has filed the present petition seeking a direction to the respondent police not to harass the petitioner under the guise of enquriy.

3. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) for the respondents.

4. Today, when the matter is taken up for hearing, the learned Government Advocate (Crl.Side) appearing for the official respondents, on instructions, would submit that on the complaint given by the fourth respondent an enquiry has been conducted, and as the dispute between the parties relates to some money transaction, after enquiry, the complaint has been closed by the third respondent as 'civil dispute'. He would further submit that there is no intention to the respondent police to harass the petitioner.

5. Considering the fact that the complaint lodged by the fourth respondent has been enquired and closed by the respondent police, no further order is required in the present petition. Accordingly, this Criminal Original Petition is closed.
