PRAYER: This Criminal Original Petition has been filed under Section 482 of Criminal Procedure Code, to direct the respondents to invoke the power conferred under Section 133 of Cr.P.C to initiate appropriate action against the encroachers as set out the petitioner representation dated 16.07.2014.

O R D E R

This petition has been filed to direct the respondents to invoke the power conferred under Section 133 of Cr.P.C to initiate appropriate action against the encroachers as set out the petitioner representation dated 16.07.2014.

2.The learned counsel for the petitioner would submit that the petitioner made a representation to the respondents on 16.07.2014 to remove the encroachment comprised in Survey No.251 belonging to the Government Poramboke situated in Kulathupatti Post, Thirumayam Taluk, Pudukkottai District. After receipt of the same, the third respondent did not take any action on the petition submitted by the petitioner.

3.The learned Government Advocate (Crl.side) would submit that the petition is still pending with the file of the third respondent herein.

4.Considering the facts and circumstances of the case, the third respondent is directed to consider the representation of the petitioner dated 16.07.2014 and pass orders on merits in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.

5. With the above direction, this Criminal Original Petition is disposed of.
