PRAYER in Crl.O.P(MD)No.9138 of 2019 Petition filed under Section 439(i)(b) of Cr.P.C to praying to modify the condition imposed in Cr.M.P.No.

1766/2019 dated 08/04/2019 on the file of the Judicial Magistrate Court, Sankarankovil to the effect that the petitioner shall execute two sureties each with 10,000/- bond instead of directing the petitioner to execute two sureties among the two sureties one of the sureties name shall be find place in the family card of the petitioner. COMMON ORDER : The Court Made the following order :- These Criminal Originals petitions have been filed to modify the conditions imposed by the learned Judicial Magistrate, Sankarankovil in Cr.M.P Nos.1765 and 1766 of 2019 dated 08.04.2019. https://hcservices.ecourts.gov.

2. The learned counsel for the petitioner would submit that by an order dated 08.04.2019 the learned Judicial Magistrate, Sankarankovil has granted bail to the petitioner on condition that the petitioner shall execute a bond for a sum of Rs.10,000/- along with two sureties each for the likesum to the satisfaction of the said Magistrate and out of which the name of the one surety should be reflected in the ration card as relative and on further condition that the petitioner shall report before the respondent police daily at 10.00a.m for a period of 15 days. He would further submit that the petitioner has married against the wishes of her family and no one is coming forward to give surety for her. He further submitted that now the petitioner's mother-in-law has come forward to give surety as one of the surety and other surety from third party. Hence he requested this Court to modify the said condition.

Hence, the Judicial Magistrate, Sankarankovil is directed to verify whether the said surety is mother-in-law of the petitioner and if he is satisfied that one of the surety is the mother-inlaw, then he can accept the surety and pass appropriate orders.
