ORDER

The instant contempt petition has been filed alleging wilful disobedience of the order of this Court dated 08.11.2024 passed in W.P. (MD)No.26613 of 2024.

2. When the matter is taken up for hearing, the learned counsel appearing for the contemnor / respondent submitted that as per the order of this Court dated 08.11.2024, the respondent fixed the enquiry on 11.03.2025 and a notice dated 27.02.2025 in this regard has also been served on the petitioner. However, he has not appeared for the enquiry. He further submitted that the petitioner is not cooperating for the enquiry. He has also produced the notice issued by the respondent in RC No.17133/04/B8/MDU, dated 27.02.2025.

3. Recording the statement made by the learned counsel appearing for the contemnor / respondent, this Court is of the view that the disobedience alleged by the petitioner cannot be termed as wilful and therefore, the present Contempt Petition stands closed.
