To accept the affidavit filed on behalf of the Petitioners/ Respondents and grant further 6 months time to complete the investigation and file the Final Report.
Prayer in Crl.OP(MD)No.14263/2015:- Criminal Original Petition filed under Section 482 of Cr.P.C. to issue a direction, directing the 2nd respondent to file final report in connection with Crime No.1/15 dated 7/2/2015 on the file of the 2nd respondent within the time.
Order : This Criminal Miscellaneous Petition coming on for hearing on this day, upon perusing the petition and the affidavit filed in support thereof on the file of the High Court and upon hearing the arguments of Mr.P.Kandasamy, Government Advocate (Crl.side) on behalf of the Petitioner and of Mr.S.Balamurugan, Advocate on behalf of the Respondent, and this Court made the following order:- Heard both sides.
2.This application has been filed to accept the affidavit of the Petitioners and to grant further six months time to complete the investigation and to file the final report in Crime No.1 of 2015, on the file of the Inspector of Police,Vigilance and AntiCorruption Wing, Kovilpatti, Thoothukudi. https://hcservices.ecourts.gov.in/hcservices/
3.From the reasons stated in the affidavit and also the details furnished by the Deputy Superintendent of Police, Vigilance and Anti-Corruption, Thoothukudi and the fact that till date 12 witnesses have been examined in detail and later, their statements have been recorded and also 102 documents have been collected and it is alleged that a sum of Rs.2.60 crores allotted to the work from the Member of Parliament Fund, which is the public money, has been misused and only in the said circumstances, the respondent is praying for six months time to complete the investigation as stated supra.
4.However, the learned counsel for the respondent has raised strong objection, as public money is involved in this matter and Respondents have to take necessary steps to expedite the enquiry and als0 needful action is to be taken to complete the investigation, as expeditiously as possible.
5.Considering the submissions made by both sides, two more months time is granted to complete the investigation and to file the final report in Crime No.1 of 2015, on the file of the Inspector of Police,Vigilance and Anti-Corruption Wing, Kovilpatti, Thoothukudi.
6.This Petition is ordered accordingly.
