The above petition has been filed seeking orders to restore the second appeal, which was dismissed for default on 28.10.2024.

2. Heard the learned counsel appearing for the petitioners, the learned counsel appearing for the first respondent and the learned Government Advocate (Civil Side) for the respondents 2 and 3.

3. It is evident from the records that the petitioners' earlier petition in CMP (MD)No.4054 of 2025 to condone the delay in filing the restoration petition came to be allowed on 04.06.2026.

4. The learned counsel appearing for the respondents would submit that they are not having objections.

5. In view of the above, this Court is inclined to set aside the order dated 28.10.2024. Accordingly, this petition is ordered and the Registry is directed to restore the second appeal on file and get the records from the trial Court at the earliest and post the main appeal on 24.06.2026.
