Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the Respondents to preserve the CCTV footage which was installed in the Respondent No. 3 on 10.01.2025 from 03.30 p.m to 06.00 pm, consequently to direct the Respondent No. 1 and 2 to take action against on basis of the representation, dated 30.01.2025 in accordance with law within the time stipulated by this Court.

O R D E R

This Writ Petition has been filed to direct the Respondents to preserve the CCTV footage, which was installed in the Respondent No. 3 on 10.01.2025 from 03.30 p.m to 06.00 p.m., consequently to direct the Respondent No. 1 and 2 to take action against on basis of the representation, dated 30.01.2025 in accordance with law. 2.The learned Government Advocate (Crl.Side) appearing for the respondent police would submit that the CCTV footage on 10.01.2025 from 03.30 p.m., to 06.00 p.m., was already erased due to insufficient storage. Therefore, the prayer of the petitioner cannot be considered.

3.Since the representation of the petitioner is still pending with the second respondent, it is for the 2nd respondent to consider his representation and pass appropriate orders in accordance with law. 2/4

4.In view of the same, this Court hereby directs the second respondent to consider the representation of the petitioner and pass appropriate orders within a period of 15 days from the date of this order 5.With the above directions and observation, this writ petition stands disposed of. Consequently, connected miscellaneous petition is closed.
