ORDER : The Court Made the following order :- The petitioner, who is arrayed as 2nd accused, in Crime No.186 of 2015 on the file of the respondent police, surrendered before the Judicial Magistrate on 05.10.2015 for the alleged offence punishable under Sections 147, 148, 506(ii), 120(b) and 302 of I.P.C., seeks bail.

2. The case of the prosecution is that on 04.10.2015, due to previous enmity, A-4 and others went to the chicken shop of the deceased and throw the chilli powder on his face and attacked him with aruval and thereby caused the death of the deceased.

3. The learned counsel for the petitioners submitted that the petitioners are innocent and they have been falsely implicated in this case. There are no specific overt acts attributed to the petitioner. He further submitted that petitioner's name is not mentioned in the First Information Report and the petitioner is in custody from 05.10.2015.

4. The learned Government Advocate (Crl.side) submitted that the friend of the accused persons was murdered by the deceased and his friends. Due to that motive, the petitioner and others went to the chicken shop of the deceased and throw the chilli powder and attacked the deceased with aruval and caused his death. and investigation is in initial stage.

5. In view of the fact that investigation is not completed and other accused are still in custody and specific overt acts are attributed to the petitioners, this Court is not inclined to grant bail to the petitioner.
