O R D E R

[Order of the Court was made by G.K.ILANTHIRAIYAN, J.] The prayer in the petition is to quash the impugned order passed by the second respondent in No.4880/Tha.ku.2/2025 dated 30.12.2025 and direct the respondents 1 and 2 to grant 15 days emergency leave to the petitioner's husband namely Arun Kumar, S/o.Later Natarajan, a life convict prisoner, C.P.No.6065, PID No.206131.

It is the case of the petitioner that her husband was convicted by the Additional Principal Sessions Judge, Ramanathapuram in S.C.No.5 of 2019 on 22.09.2021 for the offences under Sections 120 (B) r/w. 302 of IPC and sentenced to undergo life imprisonment. Against which the convict has also preferred an appeal before this Court and the same was also confirmed by this Court in Crl.A(MD) No.425 of 2021. While being so, the petitioner being wife of the convict submitted representation seeking 15 days emergency leave to her husband on the ground that he has to arrange funds for school fees to the minor

children. However it was rejected stating that leave cannot be granted as per Rule 6 of Tamil Nadu Suspension of Sentence Rules.

3. The learned Additional Public Prosecutor, on instructions submitted that even after rejection of request the petitioner was granted three days emergency leave.

4. After having availed the emergency leave the petitioner cannot once again challenge the impugned order dated 30.12.2025. In view of the same, this Court finds no infirmity or illegality in the order passed by the second respondent.

5. Hence the petition stands dismissed. Consequently connected miscellaneous petition stands closed.
