ORDER : The Court made the following order :- The petitioner/A4, who was arrested and remanded to judicial custody on 18.08.2023 for the offences punishable under Sections 8(c) r/w.20(b)(ii) (c), 27A, 28 and 29(1) of NDPS Act in NCB F.No.48/1/12/2023-NCB/MDS on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner along with other accused were found in illegal possession of 423kgs of ganja. Hence, the case..

3. The learned counsel for the petitioner submits that the respondent police has registered a false case against the petitioner and he has not committed any offence as alleged by the prosecution. He would further submit that as per the confession statement of the petitioner the petitioner and other accused person were stopped at 16.08.2023 at 9.30am but the arrest memo preferred on 17.08.2023 at 9.20 pm., and 9.40 pm., which is more than 24 hours. He would further submit that the petitioner has been arrested and remanded to judicial custody on 18.08.2023. Hence, he prays to grant bail to the petitioner.

4. The learned Additional Public Prosecutor appearing for the respondent would submit that the petitioner along with other accused were found in illegal possession of 423kgs of ganja. Further the earlier bail application filed by the petitioner was dismissed and there is no change in circumstances of the case to consider the bail petition.. Hence, he opposed to grant bail to the petitioner.

5. This Court heard both sides and perused the materials available on record.

Considering the rival submissions on either side and that the contraband involved in this case is commercial quantity and the earlier bail application filed by the petitioner was dismissed and there is no change in circumstances of the case to consider the present petition and further in this case trial commenced and most of the witnesses have been examined this Court is not inclined to grant bail to the petitioner. 3/5

7. Hence the petition stands dismissed.
