ORDER : The Court Made the following order :- The petitioner apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 294(b) and 506 (ii) I.P.C.
2.The case of the petitioner is that he is a native of Thoothukudi District and temporarily doing business at Coimbatore. The respondent police often called the petitioner over phone for enquiry in a complaint given against the petitioner. When the petitioner requested the respondent police to inform the nature of the complaint and the name of the defacto complainant, the respondent refused to furnish the details. On 16.11.2015, the petitioner attended a case at Thoothukudi. At that time, the respondent police called him for enquiry over phone. He also threatened to foist a false case, if he fails to appear for enquiry. 3.The learned counsel for the petitioner submitted that the petitioner is innocent and the respondent police is often calling him for https://hcservices.ecourts.gov.in/hcservices/ enquiry and threatened to foist a false case against him.
4.The learned Government Advocate (Criminal side) submitted that the petitioner was informed to attend the enquiry in the proceedings initiated by the Executive Magistrate under Section 110 Cr.P.C. on 15.06.2015. The petitioner is not required for any enquiry by the respondent police and no complaint is pending against him in respondent police.
