Respondents PRAYER: Contempt Petition is filed under Section 11 of the Contempt of Courts Act praying to punish the respondents for the willful disobeying and not complying the order of this Hon'ble Court, dated 26.07.2021, passed by this Court in W.P.(MD) No.12516 of 2021. Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a writ of Mandamus directing the respondent to pay the petitioner interest at the rate of 18 percentage per annum, for the period of delay from 01-05-2020 to 01-06-2021, in paying the amounts paid towards his terminal and pension benefits of the petitioner namely EPF Employees Contribution, Gratuity and Encashment of Earned/Sick Leaves and commutated value of pension, , within a time frame as may be fixed by this Honourable Court and without affecting his right to claim balance amounts towards those benefits.

O R D E R

This contempt petition has been filed alleging wilful disobedience of the order, dated 26.07.2021, made in W.P.(MD) No.12516 of 2021.

The learned Standing Counsel appearing for the respondents made a submission pursuant to the orders of this Court, 80% of the benefits due to the petitioner have been settled and the remaining benefits will be settled within a period of six weeks.

3. Recording the above submission of the learned Standing Counsel appearing for the respondents, the contempt petition is closed. However, after settlement of the benefits, if any grievance exists regarding calculation or otherwise, the petitioner is at liberty to approach the Competent Authority for redressal of his grievance in the manner known to law.
