Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused No.2, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 8(c) r/w Section 20 B (ii) (b) and Section 25 of NDPS Act, in Crime No.530 of 2015 on the file of the respondent police and hence, seek anticipatory bail.
2.The case of the prosecution is that on 03.11.2015 during vehicle checkup, the respondent police stopped the car and inspected and found 2 kg of Ganja. The respondent police arrested A1 and the petitioner ran away from the scene of occurrence and therefore, the case has been registered for the above said offences.
3.The case of the petitioner is that he is an innocent person and he is nothing to do with the alleged offence and there is no recovery shown to the concerned Court and the petitioner is noway connected with the https://hcservices.ecourts.gov.in/hcservices/ commission of the offence.
4.The learned Government Advocate (Crl.side) submitted that the respondent on inspection found that the petitioner was in possession of 2 kgs of Ganja and A1 was arrested and the petitioner on seeing the police, ran away from the scene of occurrence and if he is released on anticipatory bail, he will tamper the witnesses and hamper the prosecution.
