O R D E R

The learned Counsel for the Petitioner submits that the Petitioner is running lorry business. One Praveen and Karthi are employed as lorry Drivers. The said Praveen is alleged to have borrowed Rs.3,50,000/-, which the Petitioner had given him through Bank transactions. While so, after some time, the said Praveen asked further Rs.3,50,000/-, which was refused by the Petitioner. Enraged by the same, the said Praveen and other person, Karthi, are alleged to have taken away the lorry parked in front of the house of the Petitioner using duplicate key. Therefore, the Petitioner had given a complaint with the third Respondent. The third Respondent had summoned the said Praveen and Karthi. Thereafter, lorry was handed over to the Petitioner, after enquiry.

Subsequently, the said Praveen and Karthi had made a false claim by giving a complaint to the third Respondent stating that the Petitioner had borrowed loan from them. Based on the said complaint of Praveen and Karthi, the third Respondent had been summoning the Petitioner, which is purely a civil dispute.

2.The learned Government Advocate (Crl.side), on instructions of the third Respondent, would submit that CSR.No.27 of 2024 was registered. He undertakes that the Police will close the petition after holding enquiry in the light of the circular of the Director General of Police, Head of State Police Force, Tamil Nadu State, Chennai -4 issued in Rc.No.892914/X1/2020 dated 12.03.2021 and the circular of the Additional Director General of Police, Chennai, issued in C.No.18/ADGP/L & O/Camp/2024 dated 09.01.2024.
