ORDER
(Order of the Court was made by DR.G.JAYACHANDRAN, J.) This Public Interest Litigation is filed by the residents of Coronation Colony, Sivakasi, stating that a proposal to construct a drainage nearby their colony with an intention to let the sewage in their area without proper levelling of the road is to be stopped.
2. The prayer in the writ petition precisely reads as follows: " to direct the second respondent not to construct or develop drainage in the coronation colony and reconstruct the compound wall which was demolished by the second respondent in the coronation colony, sivakasi at his own."
3. The learned counsel for the petitioner drew our attention to the alleged representation given by the residents of the colony to the 2/5
Mayor, Sivakasi Corporation expressing the drainage scheme.
4. On reading of the affidavit as well as the representation, we are of the opinion that the petitioner herein has no locus to prevent the construction of drainage to ensure hygiene and public health. If the road laid in their colony is not even and adequate to drain the sewage, the Commissioner of Sivakasi Municipality in consultation with the Municipality Engineer has to make adequate arrangement to ensure that the drainage water does not overflow and cause health issues to the residents of the petitioner's colony.
5. With these observations, this Writ Petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed. [G.J., J.] & [K.K.R.K., J.] 19.02.2026 Index :Yes/No Internet :Yes apd 3/5
