For Respondent : Mrs.M.Anantha Devi, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.278/2016 on the file of the respondent police.

ORDER : The Court Made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 294(b), 341, 353 and 506(ii) of IPC in Crime No.278 of 2016, seek anticipatory bail.

2. Heard both sides.

3.The learned counsel appearing for the petitioners has submitted that the petitioners have not committed any offence and the respondent has filed a charge sheet by showing that the petitioners are absconding and based on the same, absconding charge sheet has been filed before the learned Judicial Magistrate NO.II, Kovilpatti and the case was taken on file in C.C.No.99 of 2019. He further submitted that only after issuance of summons the petitioners came to know about the aforesaid facts and hence, he prayed for grant of anticipatory bail to the petitioners. https://hcservices.ecourts.gov.in/hcservices/

4.The learned Government Advocate (Crl. Side) appearing for the respondent police has submitted that since the learned Judicial Magistrate has issued only summons, the apprehension of the petitioners that they will be arrested is not acceptable and hence, he opposed this petition.

5.Taking into Consideration of the submission made by the learned Government Advocate (Crl. Side) that only summons has been issued by the learned Judicial Magistrate, there is no apprehension of arrest and as such this petition is liable to be dismissed. 6.Accordingly, this petition is dismissed.
