ORDER : The Court Made the following order :- The petitioner, who is arrayed as 4th accused, in Crime No.140 of 2015 on the file of the respondent police, was arrested on 22.08.2015 for the alleged offence punishable under Sections 302 and 201 of I.P.C., and hence, seeks bail.
2. The case of the prosecution is that the deceased, who was doing money-lending business had illicit intimacy with one lady, w/o. Jeyachandran/A-1. Hence, the petitioner along with other accused came with knife and attacked the deceased and caused severe injuries.
3. The case of the petitioner is that he is innocent and he was arrested and remanded to judicial custody on 22.08.2015 and he has been in incarceration for more than 90 days in Borstal School. 4.The learned Government Advocate (Crl.side) raised objection to grant bail to the petitioner stating that investigation is pending and the petitioner and other accused committed a serious offence.
5. This Court, by the order dated 03.11.2015, dismissed the earlier bail petition filed by the petitioner and A-1. Now, in the present petition, the learned counsel for the petitioner stated that the petitioner is in judicial custody from 22.08.2015 and his name is not found in the First Information Report. A-2 and A-3 were already released on bail in Crl.O.P.(MD).No.20919 of 2015.
6. Considering the fact that the petitioner is in judicial custody from 22.08.2015 and also considering the fact that A-2 and A-3 were already released on bail by this Court, this Court is inclined to grant bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the learned Judicial https://hcservices.ecourts.gov.in/hcservices/
