ORDER : The Court Made the following order :- The petitioner/sole accused, who was arrested and remanded to judicial custody on 26.10.2015 for the alleged offence punishable under Section 306 of the Indian Penal Code in Crime No.414 of 2015 on the file of the respondent police and hence, seeks bail.
2. The case of the prosecution is that on 25.10.2015, the petitioner, who is the husband of the deceased, demanded money from the deceased for purchase of liquor and tortured her and due to that, she committed suicide.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence. Both the petitioner and deceased got married 14 years back and out of their wedlock, they had one female child, aged 13 years and one male child, aged 11 years respectively. The deceased was suffering from stomach pain and she could not tolerate the pain, therefore, she had committed suicide. His mother-in-law falsely implicated the petitioner only to harass him and to take the custody of the children from the petitioner. 4. Heard the submissions of the learned Government Advocate (Criminal Side).

Considering the facts and circumstances of the case and also considering the fact that the petitioner is in judicial custody from 26.10.2015, this Court is inclined to grant bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Paramakudi and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m., until further orders. sd/- 23/11/2015 / TRUE COPY / Sub-Assistant Registrar TO 1 THE JUDICIAL MAGISTRATE, PARAMAKUDI.
