ORDER

This Criminal Original Petition has been filed to direct the third respondent herein not to harass the petitioner based on the baseless complaints under the guise of enquiry.

2. According to the petitioner, the petitioner is the pawn broker and he used to receive the jewels under pledge and in turn, he pledged the jewels to the Bank. While so, the customers lodged a false complaint. Based on the complaint, the third respondent police started to harass the petitioner to settle the matter. Already he settled the money to most of the customers and yet some amounts have to be paid to few customers. While so, the respondents taking advantage of the complaint lodged by the third parties, started to torture the petitioner. Hence, the present petition.

3. The learned Additional Public Prosecutor appearing for the respondents would submit that one Vijayalakshmi lodged a complaint before 2/5

the third respondent and based on the complaint, they made enquiry, for that enquiry, they called the petitioner. But he did not appear before the respondent. However, they will complete the enquiry within a period of one week and thereafter, they will act in accordance with law. During the enquiry, the third respondent has not harassed the petitioner as alleged by the petitioner in the affidavit.

4. Since the third respondent conducting enquiry based on the complaint given by one Vijayalakshmi and seeks time to complete the enquiry, it is appropriate to direct the third respondent to complete the enquiry, within a period of one (1) week from the date of receipt of a copy of this order. Accordingly, ordered.

5. With the above said direction, this Criminal Original Petition stands disposed of.
