O R D E R

Alleging wilful disobedience of the order passed by this Court in W.P.(MD)No.19602 of 2022, dated 25.08.2022, this Contempt Petition has been filed.

2.In the order under contempt, a direction was issued to the respondents to pay interest at the rate of 6% per annum on the belated payment of the retirement benefits commencing from the date of his retirement.

3.Today, when the matter was taken up for hearing, the learned standing counsel for the respondent Corporation has produced a copy of the proceedings, whereby, when the gratuity amount was paid, they have paid the interest at the rate of 6% per annum for the period of 17 years commencing from 30.06.2003 till 30.06.2020.

4.In view of the same, the disobedience alleged cannot be termed as wilful disobedience. In case, the petitioner is of the view that the respondent Corporation have not properly calculated the interest amount, liberty is granted to the petitioner to challenge the same in accordance with law. Accordingly, this contempt petition stands closed. 25.08.2023 NCC: Yes/No Index:Yes/No RR
