ORDER

This petition has been filed seeking a direction to the second respondent to give police protection to the life and limb of the petitioner and her husband from the third and fourth respondents.

2. The grievance of the petitioner is that, she has mortgaged a property in favour of the third respondent herein and she has also repaid the mortgaged amount with interest. Now, the third and fourth respondents are demanding more interest. In the above circumstances, the petitioner has given a complaint before the https://hcservices.ecourts.gov.in/hcservices/

second respondent police against the third and fourth respondents, but, no action has been taken so far. Even thereafter, the third and fourth respondents threatened the petitioner. Hence, the petitioner has filed the present petition seeking for the aforesaid relief.

3. Mr.K.Suyambulinga Bharathi, learned Government Advocate (Criminal side), takes notice on behalf of the first and second respondents. Considering the nature of order being passed in this petition and it is no way prejudice to the third and fourth respondents, notice to them is dispensed with.

4. The learned Government Advocate (Criminal side) appearing for the first and second respondents, on instructions, submitted that the petitioner filed a complaint against the third and fourth respondents and the second respondent police are taking steps to enquire the complaint and also requested the petitioner to appear for enquiry. But the petitioner did not turn up for enquiry. In the above circumstances, the second respondent is not in a position to conduct further enquiry in this case.

5. Considering the fact that already enquiry is pending, based on the complaint given by the petitioner, the petitioner is directed to appear and co-operate for enquiry before the second respondent.

6. The Criminal Original Petition is closed with the above direction.
