ORDER : The Court Made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offence under Section 379 IPC, in Cr.No.10 of 2019 on the file of the respondent police, seek anticipatory bail.

2.It is the case of the prosecution that on 09.01.2019 at about 02.00 p.m., the respondent police office bearers way laid the petitioners. At that time, the respondent has understood that sand theft was committed by the petitioners, but the petitioners were escaped from there and subsequently involved tractor was captured by the respondent.

3.The learned counsel appearing for the petitioners would submit that the petitioners did not commit any offence as alleged by the prosecution.

4.The learned Government Advocate (Crl.Side) appearing for the respondent State would submit that petitioners are having 17 previous cases.

5.Considering the facts and circumstances of the case and also considering the serious allegations levelled against the petitioners, this Court is not inclined to grant anticipatory bail to the petitioners and accordingly, this petition is dismissed. sd/- 04/02/2019 / TRUE COPY / Sub-Assistant Registrar (C.S.)
