Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the respondents 1 to 5 to rotate the priesthood in favour of the petitioner of Sri Petchiamman Temple run by 'Narasi Koottam' Community situated in Kovilpatti, Errampatti, Vadipatti Taluk, Madurai District by considering the representation of the petitioner dated 12.01.2022 within a time frame to be stipulated by this Court. *********** This writ petition has been filed for a Mandamus seeking for a direction to the respondents 1 to 5 to rotate the priesthood in favour of the petitioner for Sri Petchiamman Temple run by 'Narasi Koottam' Community situated in Kovilpatti, Errampatti, Vadipatti 1/3
Taluk, Madurai District by considering the representation of the petitioner dated 12.01.2022 within a time frame to be fixed by this Court.
2.It is the case of the petitioner that the priesthood for the aforementioned temple is rotated between the petitioner and the sixth respondent. However, since the said rotation has not taken place, the petitioner has submitted a representation to the official respondents on 12.01.2022. Since the said representation has not been considered till date, the petitioner has filed this writ petition.
3.Heard Mr.N.Sankar Ganesh, learned counsel appearing for the petitioner and Mr.B.Saravanan, learned Additional Government Pleader who accepts notice on behalf of respondents 1 to 5. 4.Learned Additional Government Pleader on instructions would submit that the first respondent has already forwarded the representation of the petitioner dated 12.01.2022 to the Hindu Religious and Charitable Endowments Department. 5.No prejudice would be caused to the official respondents if the petitioner's representation dated 12.01.2022 is considered on merits and in accordance with law after affording a fair opportunity of hearing to all the necessary parties including the petitioner as well as the sixth respondent.
6.For the foregoing reasons, this Court directs the fourth respondent to consider the petitioner's representation dated 12.01.2022 seeking for rotation of priesthood in favour of the petitioner for Sri Petchiamman Temple run by 'Narasi Koottam' Community situated in Kovilpatti, Errampatti, Vadipatti Taluk, Madurai District and pass final orders on merits and in accordance with law after affording a fair opportunity of hearing to the petitioner and other necessary parties including the sixth respondent within a period of two [2] weeks from the date of receipt of a copy of this order.
7.With the above direction, the Writ Petition stands disposed of. There shall be no order as to costs.
