Respondents PRAYER: Writ petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records pertaining to the impugned order passed by the third respondent in his proceedings in Na.Ka.No.5907/E2/dated 2021, dated 21.09.2022 quash the same as illegal and consequently direct the 2nd respondent to consider the petitioner representation dated 17.11.2022 for cancelled the impugned document vide Registration No.1598/2021, dated 07.07.2021 at the Joint II Sub Registrar, Periyakulam, Theni District District within a time frame.

Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for respondents. 2.The petitioner impugns the document executed in favour of the private respondents. She filed a complaint before the second 2/ 4

3 W.P.(MD)No.2531 of 2023 respondent. The second respondent rejected the petitioner's request vide proceedings dated 21.09.2022. Aggrieved by the same, the petitioner has filed an appeal before the second respondent on 17.11.2022. When the petitioner has already availed her appeal remedy before the second respondent, it is not necessary for this Court to examine the correctness of the order passed by the third respondent.

3.The second respondent is directed to dispose of the petitioner's appeal on merits and in accordance with law after due notice to all the persons concerned, within a period of five weeks from the date of receipt of a copy of this order. I make it clear that I have not gone into the merits of the matter. It is open to the second respondent to pass orders one way or the other.
