PRAYER in M.P.No.1 of 2008 in Crl.R.C.No.931 of 2008: To suspend the sentence imposed on the petitioner in pursuant to the order dated 02/09/2008 passed in C.A.No.26 of 2008 by the Fast Track Court, Dindigul for the offence under section 138(a) of Negotiable Instruments Act 1882 to undergo Simple Imprisonment in confirming the order dated 31/03/2008 passed in C.C.No.607 of 2005 by the Judicial Magistrate Court No.I, Dindigul and enlarge the petitioner on bail in the event of his arrest, pending disposal of the Criminal Revision.
PRAYER in Crl.R.C.No.931 of 2008:
To call for the entire records relating to the C.C.No.607 of 2005 on the file of Judicial Magistrate No.I, Dindigul and C.A.No.26 of 2008 on the file of the Fast Track Court, Dindigul and set aside the order dated 02/09/2008 passed in C.A.No.26 of 2008 in so far as directing the petitioner to pay fine amount of Rs.10,000/- and consequential punishment and six months simple imprisonment. Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/s.J.MALLIGA, Advocate for the petitioner, the court made the following order:- This Criminal Miscellaneous Petition has been filed to relax the condition imposed in MP(MD)No.1 of 2008 in Crl.RC(MD)No.931 of 2008, dated 31.10.2008.

2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Crl. Side) appearing for the respondent.
3. On perusal of the report received from the learned Magistrate No.I, Dindigul and considering the facts and circumstances of the case and also considering the age of the petitioner condition already imposed on the petitioner is fully relaxed.
4. Accordingly, the Criminal Miscellaneous Petition is allowed.
