Respondent PRAYER: Petition is filed under Section 482 of the Code of Criminal Procedure, to accept the surrender of the petitioners before the Special Court for SC ST (Prevention of Atrocities) Act, ie., the I Additional District and Sessions Judge (Special Court for PCR Cases), Thanjavur in connection with the case in Crime No.227 of 2015 on the file of the respondent Police.

O R D E R

The petitioners, who apprehend arrest for the offences punishable under Sections 294(b), 352 IPC and Section 3(1)(X) of SC & ST (Prevention of Atrocities) Act, in Cr.No.227 of 2015, on the file of the respondent police, move this petition seeking direction to the learned I Additional District and Sessions Judge (Special Court for PCR Cases), Thanjavur, to consider the bail applications filed by the petitioners on the same day of their surrender.

2.The offences complained of, other than the offence under the Special enactment, even though serious since the injured has been discharged from the hospital the same can be considered by the said Court on the same day.

3.Therefore, the learned I Additional District and Sessions Judge (Special Court for PCR Cases), Thanjavur, is directed to accept the surrender of the petitioners and consider their bail application on the very same day purely on the basis of merits and to pass suitable orders, in the event of petitioners surrendering before the said court within 15 days from the date of receipt of the order and their filing of petition seeking bail. Accordingly, this Criminal Original Petition is ordered.
