Writ Petition filed under Article 226 of the Constitution of India, seeking for the issuance of Writ of Certiorarifiled Mandamus, to call for the records pertaining to the impugned order passed by the 1st respondent in the proceedings No.81 dated 16.12.2020 and consequent appeal order passed by the 2nd respondent passed in Ku.No.024954/153/NiPe.3/D.2/2015 dated 13.05.2015 and the original order passed by the 3rd respondent in Ka.No. 1858/Ni.Pe/Ni.Me/2014-4 dated 23.01.2015 and quash the same and direct the respondents to pass appropriate orders providing the relief to petitioner which he lost in view of the impugned orders. ORDER
The petitioner is working as a Foreman Grade-I at Distribution Circle, Nagercoil. While he was working as Commercial Inspector at Nagercoil, he was issued with a charge memo dated 02.12.2014. Thereafter, an enquiry was conducted and based on the enquiry report, the 3rd respondent, by order dated 23.01.2015, passed an order imposing punishment of postponement of increment of salary for two years without cumulative effect. Challenging the same, the petitioner has preferred an appeal before the 2nd respondent, which was also dismissed by the 2nd respondent, by order dated 13.05.2015. 2/5
Thereafter, the petitioner filed a mercy petition before the first respondent, which was also rejected by order dated 16.12.2020. Challenging the same, the present writ petition has been filed.
2. Today, when the writ petition is taken up for hearing, it is reported that the petitioner died.
3. The learned counsel appearing for the petitioner has expressed that he is not able to contact the legal heirs of the petitioner.
4. In view of the submission made by the learned counsel for the petitioner, the writ petition is closed with liberty to the legal heirs to pursue the same, if so advised.
